On 15 April 2010, Aurizon Network withdrew its 2009 draft access undertaking (DAU) and submitted a new voluntary draft access undertaking (the April 2010 DAU) for approval. The April 2010 DAU set out the terms and conditions under which Aurizon Network proposes to provide access to rail infrastructure covered by the undertaking.

Under section 136 of the Queensland Competition Authority Act 1997 (the QCA Act), we had to consider and decide whether or not to approve Aurizon Network’s 2010 DAU.

We received submissions from 11 stakeholders in response to the 2010 DAU.

On 2 June 2010, we published our draft decision on the coal tariff aspects of the 2010 DAU.

These prices and price-setting rules were included in an amendment to the 2008 undertaking.

On 21 September 2010, we released our final decision to not approve the April 2010 DAU.

On 22 September 2010, QR Network submitted a replacement undertaking and, on 29 September 2010, submitted an addendum that corrected a number of minor cross-referencing errors contained in the September 2010 DAU.

We received three submissions from stakeholders in regard to QR Network’s resubmitted 2010 DAU by the due date of 30 September 2010.

On 1 October 2010, we released our final decision to approve QR Network’s resubmitted 2010 DAU.
